(Re)insurance Disputes & Bad Faith Litigation

  • Successfully resolved 14 class actions and a parallel criminal investigation arising from the collapse of three risk retention professional liability groups (doctors, hospitals, lawyers) that had sought damages in excess of $300 million.
  • Obtained summary judgment in favor of an insurer against the Miami Dolphins relating to a multimillion-dollar claim for workers' compensation of a paralyzed professional football player.
  • Obtained summary judgment and final dismissal of case on behalf of insurer and its holding company in protracted, multimillion-dollar bad faith and corporate veil-piercing case in Oklahoma.
  • Obtained arbitration judgment of $25 million for a reinsurer against a Florida-based auto insurer relating to overcharges on allocated loss adjustment expenses.
  • Obtained summary judgment for an insurer against a municipal pool in a multimillion-dollar dispute relating to claim for workers' compensation for state employees.
  • Obtained favorable settlement from Liquidator to forego preference action against client concerning security transferred to trust immediately prior to insolvency and allegation that our client was responsible for the insolvent company’s demise.
  • Resolved bad faith exposures and obtained a significant discount on a $30 million judgment awarded to a double amputee in a California case.
  • Obtained permanent injunction on behalf of insurer against an MGA, requiring the MGA to cease issuing workers’ compensation policies on client’s paper.
  • Obtained summary judgment declaring no duty to defend or indemnify title company under professional liability policy even where complaint included negligence counts arising from mortgage stacking and loans to straw buyers.
  • Successful defense of a large national insurer in numerous related state and federal class actions involving allegations of fraud in the pricing of workers’ compensation insurance for loss-sensitive commercial insurance programs.

Complex Commercial Litigation

  • Successfully obtained a TRO and preliminary injunction in trade secret case involving the departure of over 25 key employees to a competitor.
  • Successfully defend global accounting and auditing firms from audit malpractice claims in state and federal courts, including parachuting in to take over defense after appellate reversal of audit malpractice jury verdict in excess of $500 million arising from involvement of bank in factoring fraud.
  • Recovered millions in settlement following forensic investigation and trade secret action against client’s former employees and competitor that hired them and misappropriated training materials and confidential customer information.
  • Obtained dismissal of state law fraud and breach of fiduciary claims brought against REIT over valuation and dividend reinvestment program.
  • Obtained dismissal of shareholder derivative claims and direct disclosure claims brought against mining company and outside directors during proxy battle.
  • Obtained $200 million interpleader judgment in complex mass tort litigation arising from commuter rail collision involving 25 fatalities and multiple injuries.
  • Obtained dismissal with prejudice of multimillion-dollar fraud claims against broker following the failed sale of professional football team.

Corporate Governance and Investigations

  • Negotiated and signed Non-Prosecution Agreement with the US Dept. of Justice, and parallel agreement with the SEC.
  • Negotiated resolution of regulatory investigations brought in Australia, Germany, UK, and Ireland relating to financial (finite) reinsurance products.
  • Negotiated Consent Decree with the Delaware Department of Insurance relating to an inter-company transaction.
  • Conducted internal review and negotiated resolution with the US Treasury Department's Office of Foreign Asset Control (OFAC) relating to transactions involving Cuba and Iran.
